Terms and Conditions of Use for the Client

By registering and using our services, you accept all the conditions of this Agreement. Please review this important information carefully before using our services. MIKAMBISTA reserves the right to unilaterally modify its Terms and Conditions (“Agreement”) by publishing a new version on the Company’s website.

ABOUT MIKAMBISTA

MIKAMBISTA is an online currency exchange company governed by Peruvian laws, incorporated as MIKAMBISTA INVESTMENT MANAGEMENT SAC with its registered tax domicile at Av. José Gálvez Barrenechea Nro. 200 Int. 102 Urb. Santa Catalina, district of La Victoria, province and department of Lima, Peru.
Furthermore, MIKAMBISTA is authorized to operate as a currency exchange house under Resolution No. 01576-2023 issued by the Superintendency of Banking, Insurance, and AFP (hereinafter SBS), and maintains a compliance officer duly registered with this entity.

ABOUT THE SERVICE

MIKAMBISTA offers its services online through its web portal (consisting of a web landing page) hosted at https://MIKAMBISTA.com/ and https://MIKAMBISTA.COM.PE/#/LOGIN. The web portal has been created for the purpose of providing currency exchange services within Peru.
Any user who registers through the web platform shall be referred to as the “CLIENT“. MIKAMBISTA only offers its services to CLIENTS who hold a bank account with a financial institution supervised by the SBS, through which they can transfer and receive the funds resulting from the currency exchange service.

ACCEPTANCE OF THE AGREEMENT

To use our Services, the CLIENT must electronically accept this Agreement and our Privacy Policy. In the event that the client does not agree with them, they must refrain from using the Platform and the Services.
By registering, you expressly declare that you have read, understood, and fully accepted these documents. Notwithstanding, by using our Platform and/or our Services, you confirm your acceptance of this Agreement.
The purpose of this agreement is to inform THE CLIENT of MIKAMBISTA’s Terms and Conditions of use. In this regard, the CLIENT must read it carefully and understand it before using the services. The simple use of the web portal that MIKAMBISTA makes available shall be construed as acceptance of these terms, and therefore constitutes a commitment to respect the conditions of use and to observe the regulations governing exchange bureaus under Peruvian law.

FEES

MIKAMBISTA does not charge any commission fee for the use of its services.
However, THE CLIENT must consider that there are commission fees or Financial Transaction Taxes (ITF) levied by financial institutions. Additionally, in the event that THE CLIENT uses bank accounts from regions outside of Lima and MIKAMBISTA incurs inter-city/regional banking fees (comisiones interplaza), MIKAMBISTA will pass on the fees charged by the financial institutions to the CLIENT.

HOURS OF OPERATION

MIKAMBISTA’s hours of operation are Monday through Friday from 08:00 to 18:00 hours, and Saturdays from 08:00 to 13:00 hours, provided they are business days, thereby excluding local and international holidays. Therefore, the operations and transfers requested by the CLIENT must be carried out in accordance with the aforementioned schedule.
If the transfer of the amount by the CLIENT to MIKAMBISTA’s accounts is made outside the hours of operation, the transaction may be cancelled or accepted under the conditions that MIKAMBISTA deems appropriate.

USE OF OUR PLATFORM

To use our services, the Client must be over 18 years of age and hold a bank account in Soles (S/) and/or US Dollars (USD) with a financial institution in Peru supervised by the SBS. The account registered with MIKAMBISTA shall be for personal and non-transferable use.
In the event that we request additional information to verify the Client’s identity, the Client must comply by providing such information and ensuring that the data provided is correct and up to date.
MIKAMBISTA may reject any new client or transfer at its sole discretion and without stating a cause upon suspicion that our platforms are being used to perform fraudulent and/or criminal operations.
Similarly, MIKAMBISTA is authorized to terminate accounts at its discretion upon suspicion that they are being used for the execution of fraudulent operations and/or criminal acts.
Once MIKAMBISTA has executed the transaction, it cannot be reversed, and the company shall not be held liable under any circumstances for any damage or loss suffered by the client as a consequence of the client’s negligence when entering the requested data.

CLIENT REGISTRATION

  • Account Creation: To register as a natural person, the individual must be at least eighteen (18) years old and have the legal capacity to enter into contracts. Registration is open to both Peruvian nationals and foreign citizens. In the case of legal entities (companies) or other organizations, they must be domiciled in Peru, and their representatives must be duly authorized by said entities.
  • Personal Use Declaration: The Client declares and warrants that the user account created on the Platform is for their personal use or on behalf of the company they represent, and that they are not acting on behalf of third parties. Likewise, the Client declares that the data provided is true and current (personal and contact data, legal representative information, shareholders, company details, and ID documents), assuming full responsibility for keeping it properly updated.
  • Credentials Security: The Client must register a personal email address and a secure password, which shall be under their exclusive responsibility and must not be shared. Any action performed through access with said password is presumed to be carried out by the Client. If the Client loses control of their password or it is exposed to risks, they must proceed to change it and notify MIKAMBISTA immediately.
  • Verification of Information: Inasmuch as MIKAMBISTA is a company that complies with anti-money laundering regulations established by the UIF-SBS, it will verify the registered information. To this end, MIKAMBISTA may access other sources of information and, if necessary (if the submitted information is illegible or insufficient, among other reasons), will contact the Client at any time it deems appropriate. MIKAMBISTA reserves the right of admission of the Client.
  • Account Cancellation: If the Client requires the cancellation of their account, they must request it via email at: contacto@mikambista.com. Furthermore, due to a breach of the provisions set forth in these Terms and Conditions or according to MIKAMBISTA’s reasonable judgment, MIKAMBISTA may temporarily deactivate the Client’s accounts or permanently cancel them, denying access to the Platform.

BANK ACCOUNT REGISTRATION

The Customer must register the details of the corresponding bank account, whether in Peruvian Soles (PEN) or U.S. Dollars (USD). If the account is the Source Account (from which the Customer will transfer funds), it must always be owned by the Customer registering the transaction or by the company they represent. MiKambista reserves the right to reject any transaction if it determines otherwise.

MiKambista accepts bank accounts from:

  • BCP, Interbank, and BBVA, provided the accounts were opened in Lima, Peru.
  • Other banks with accounts opened in Lima, Peru. In such cases, the Customer must provide the Interbank Account Code (CCI) and will be responsible for any applicable interbank transfer fees charged by their financial institution.

MiKambista shall not be responsible for any delays incurred by the Customer’s financial institution when transferring funds from the Customer’s account to MiKambista’s account, whether the transfer is made within the same bank or between different banks.

MiKambista shall not be liable for any errors, costs, fees, commissions, or delays resulting from the Customer transferring funds to an account other than the one specified by MiKambista.

MiKambista shall not be liable for any errors, costs, fees, commissions, or delays resulting from the Customer transferring funds from an account in one currency to an account in a different currency.

MiKambista may request additional information in order to comply with applicable Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) regulations.

CURRENCY EXCHANGE TRANSACTIONS

To register a transaction, the Customer must use their user account through the MiKambista website or any other digital channels made available by MiKambista. The Customer must provide the following information:

  • The amount to be exchanged and the type of transaction (Buy or Sell).
  • The destination bank account number in Peruvian Soles (PEN) or U.S. Dollars (USD), which must belong to the same Customer.
  • The Customer’s identification document number (National ID, Foreigner ID Card, Tax ID (RUC), or Passport).

Once these steps have been completed, the transaction will be considered registered, and a currency exchange agreement between the Customer and MiKambista shall be deemed established.

The Customer must then continue with the following process:

The Customer must transfer the source amount from their previously registered bank account to a MiKambista bank account within a maximum period of fifteen (15) minutes from the moment the transaction is registered in order to maintain the agreed exchange rate.

The transfer must be made from the Customer’s personal bank account or from the bank account of the company they represent. MiKambista does not accept cash deposits or checks. If such payment methods are detected, the transaction will be canceled.

Please note that the transaction will only be processed and completed once MiKambista has confirmed receipt of the transferred funds. Verification will be performed using the transaction reference number entered by the Customer through the website or mobile application.

MiKambista will never request access to the Customer’s bank accounts. To complete the exchange transaction, the Customer must independently initiate the bank transfer through their own banking platform.

It is also the Customer’s responsibility to send the funds during MiKambista’s business hours to ensure timely processing of the transaction.

ELECTRONIC RECEIPTS AND INVOICES

Electronic receipts (Receipts) will be issued to Customers registered as Individuals, while electronic invoices (Invoices) will be issued to Customers registered as Businesses.

The corresponding receipt or invoice will be issued according to the profile used to complete the transaction, whether as an Individual or as a Business.

In accordance with regulations issued by the National Superintendence of Customs and Tax Administration (SUNAT), foreign currency exchange transactions are exempt from Value Added Tax (VAT). Therefore, no additional VAT charges apply.

ANTI-MONEY LAUNDERING AND COUNTER-TERRORIST FINANCING (AML/CFT)

By using MiKambista’s services, the Customer represents and warrants that all transactions will be carried out in compliance with all applicable anti-corruption laws and Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) regulations.

The Customer further declares that all funds used to carry out transactions under these Terms and Conditions originate from lawful sources.

The provision of the services, as well as the resolution of any claims, disputes, or controversies arising from them, shall be governed by the laws of the Republic of Peru.

DATA PRIVACY

When registering on our website, the Customer creates a password that is known only to them. The Customer is solely responsible for keeping this password confidential in order to protect their privacy and account security.

For security purposes, MiKambista stores passwords in encrypted form.

MiKambista will not disclose any Customer information except when required by a lawful order issued by a competent authority.

All personal information voluntarily provided by the Customer is subject to security controls in accordance with the AML/CFT policies established by the Superintendence of Banking, Insurance and Private Pension Funds (SBS). If additional verification is required, the Customer will be notified accordingly.

MiKambista will use the Customer’s personal information exclusively for the following purposes:

  • Verify the Customer’s identity in compliance with applicable Anti-Money Laundering and Counter-Terrorist Financing (AML/CFT) regulations issued by the SBS.
  • Verify the accuracy of the information provided by the Customer.
  • Contact the Customer regarding activities directly related to the currency exchange process, in accordance with these Terms and Conditions.
  • Respond to and follow up on inquiries or requests.
  • Perform anonymous statistical analysis.
  • Store personal data as necessary for the provision of our services.
  • Notify Customers of changes to our services.
  • Comply with applicable regulations issued by the Financial Intelligence Unit (UIF), the SBS, and any current or future legal requirements.

LIMITATION OF LIABILITY

MiKambista shall only be responsible for providing its currency exchange services through its official platforms.

MiKambista, its representatives, and employees shall not be liable for any damages arising from the use of the Platform and/or the Services, including but not limited to:

  • Any error, omission, interruption, defect, or delay in the processing of transactions or communications, or any unavailability of the Services and/or the Platform.
  • Any loss or loss of profits resulting from decisions made based on information published by MiKambista.
  • Any unlawful interception, theft of information, unauthorized access, intrusion, or security breach carried out by third parties.
  • The access to, use of, accuracy, adequacy, or any similar issues related to links to third-party websites or content made available through the Platform.

Furthermore, with respect to transactions involving Financial Institutions, MiKambista shall not be liable for:

  • Any fees, commissions, or other charges imposed by Financial Institutions, as well as any delays resulting from errors or inaccuracies made by the Customer when entering information into the Platform or executing financial transactions, including transfers made to an account other than the one designated by MiKambista during the transaction registration process.
  • Any fees, commissions, or other charges, as well as the time required by Financial Institutions to process Interbank Transfers or Interbranch Transfers.

SERVICE AVAILABILITY

The website shall remain available except in cases of force majeure, unforeseen circumstances, or third-party events that prevent or restrict access to or use of the Service. Such circumstances may include, but are not limited to, regulatory changes.

In any of these situations, if a transaction is already in progress and the Customer has completed the transfer of funds, MiKambista will refund the transferred amount as soon as reasonably possible.

UPDATES TO THE TERMS AND CONDITIONS

MiKambista reserves the right to modify or update these Terms and Conditions at any time in response to regulatory changes, legal requirements, or improvements to its services at MiKambista’s sole discretion.

MiKambista will make reasonable efforts to notify Customers of such updates by sending a notice to the email address registered with their account or by publishing the updated Terms and Conditions on the website.

ENTIRE AGREEMENT

By accepting these Terms and Conditions, the Customer declares that all information provided to MiKambista is complete, accurate, truthful, and up to date.

The Customer assumes full responsibility for any discrepancies between the information provided and the actual facts, acknowledging that providing false information or documents may constitute fraud or document forgery under applicable criminal law.

The Customer further declares that the technological platform covered by this Agreement will be used exclusively for lawful purposes and will not be used to engage in any activity classified as a criminal offense under applicable law.

The interpretation, validity, performance, and enforcement of these Terms and Conditions shall be governed exclusively by the laws of the Republic of Peru.
